General Terms & Conditions

1. General

These terms and conditions apply to all courses, trips, experiences and equipment rentals offered by Kajakkguiden AS (hereafter "Kajakkguiden"). By booking and participating in Kajakkguiden's activities, you accept these terms.

2. Health requirements and fitness

  • All participants must be able to swim at least 200 metres and be comfortable in water.
  • Participants must be in sufficient physical condition to complete the activity in question. If you are unsure, please contact us in advance.
  • You are responsible for disclosing any health conditions that may affect your or others' safety, including medications, allergies, epilepsy, cardiovascular diseases or other relevant conditions.
  • Kajakkguiden reserves the right to refuse participation if it is deemed to pose a safety risk.
  • The minimum age is 16 years. Participants under 18 must have written consent from a parent or guardian.

3. Photo and video consent

During courses and trips, photos and videos may be taken for use in marketing, social media and on the website. By participating, you consent to such use of photos and videos featuring you, unless you inform us otherwise.

You may withdraw your consent at any time by contacting us. Relevant photos and videos will then be removed as soon as possible.

4. Booking and payment

  • A booking is binding once you receive confirmation from us by email.
  • Payment is made in advance by invoice or electronic payment. A course place is only guaranteed upon receipt of payment.
  • All prices on the website are stated in Norwegian kroner including VAT where applicable.
  • Kajakkguiden reserves the right to cancel courses or trips if there are too few participants (minimum number is stated at booking). In case of cancellation by Kajakkguiden, the full amount is refunded.

5. Cancellation and refunds

The following cancellation rules apply to all courses and trips:

  • Exceptions to the cancellation rules are made in case of illness with a medical certificate. Please contact us as soon as possible.
  • Rebooking to another date is possible up to 7 days before the original course start, subject to availability.
  • If Kajakkguiden cancels due to weather or other safety-related reasons, a new date or full refund is offered.

6. Equipment and clothing

  • Equipment (kayak, paddle, buoyancy aid, spray skirt and optionally dry suit) can be rented in addition to the course price. See rental prices on the website.
  • You are responsible for bringing appropriate base layers: wool or synthetic underwear (never cotton), extra change of clothes, packed lunch and drinks.
  • Borrowed equipment must be handled with care. You are liable for damage beyond normal wear and tear caused by negligence.
  • You may use your own sea kayak by agreement with the instructor. The kayak must be suitable for the conditions and approved by us in advance.

7. Safety and liability

  • Safety is Kajakkguiden's highest priority. All courses and trips are conducted in accordance with the Norwegian Paddling Federation's guidelines.
  • You must follow the instructor's directions at all times. Breach of safety instructions may result in removal without refund.
  • Kajakkguiden reserves the right to change routes, shorten trips or abort activities if weather, sea conditions or other factors make it necessary for safety reasons.
  • Participation in courses and trips is at your own risk. Kajakkguiden is responsible for providing proper instruction and guidance, but cannot be held liable for accidents that occur despite the exercise of normal diligence.
  • Participants under the influence of alcohol or other intoxicants will be refused participation without refund.

8. Weather and natural conditions

Sea kayaking is an outdoor activity affected by weather and sea conditions. Kajakkguiden monitors conditions continuously and makes decisions based on safety.

  • Light rain is normal and rarely a reason for cancellation. Wind and waves are the most important factors considered.
  • In case of cancellation due to weather, notice is given as early as possible, and a new date or full refund is offered.
  • The instructor has the final say in all decisions related to weather and whether to proceed.

9. Equipment rental

  • Rental of kayaks and equipment requires a valid Paddle Certificate (Våttkort) from the Norwegian Paddling Federation or equivalent documented competence.
  • The renter is responsible for rented equipment from pickup to return, including loss and damage.
  • Equipment must be returned clean and in the same condition as at collection.
  • The rental period starts from the agreed pickup time regardless of actual use.

10. Force majeure

Kajakkguiden is not liable for failure to fulfill obligations due to circumstances beyond Kajakkguiden's control, including extreme weather, natural disasters, pandemics, strikes, public restrictions or other circumstances that could not reasonably have been foreseen.

11. Disputes

Any disputes shall first be attempted resolved amicably. If the parties cannot reach agreement, the dispute may be brought before the ordinary Norwegian courts with Sunnmøre District Court as the legal venue.

12. Right of withdrawal

In accordance with the Norwegian Right of Withdrawal Act §22(m), leisure services with an agreed time or period for performance are exempt from the right of withdrawal. This applies to all courses, trips and experiences at Kajakkguiden that have a fixed date and time.

This means that the Right of Withdrawal Act does not grant the right to cancel the booking after it has been confirmed, beyond what follows from the cancellation rules in section 5 above.

For equipment rental without a fixed date, the ordinary rules of the Right of Withdrawal Act apply, with a 14-day withdrawal period from the time of agreement.
